These terms and conditions govern the contract of sale between the purchaser (hereinafter referred to as the “Purchaser”) and NUNZIO ALFONSO S.R.L., with its registered office at Zona Industriale Giammoro - 98042 Pace del Mela (ME), registered in the Messina Companies Register under number ME-252028, VAT No. IT03655770836, certified email address: nunzioalfonsosrl@pec.it (hereinafter referred to as the “Seller”).
1. Scope of the General Terms and Conditions of Sale
The following general terms and conditions of sale govern all sales contracts concluded between the Buyer and the Seller via the website www.alfonsoforni.com. Each contract is subject to the general terms and conditions of sale published on the website at the time the contract is concluded.
Any amendment proposed by the Buyer shall not alter these general terms and conditions of sale unless expressly accepted in writing by the Seller.
2. Parties to the contract and geographical scope
The online shop at www.alfonsoforni.com is intended for the exclusive use of consumers; that is to say, it is reserved for retail sales.
3. Invoices
Should you request an invoice to be issued to a private individual or a VAT-registered business, you must provide your tax code, VAT number and certified email address (PEC). Without these two pieces of information, we will be unable to issue an invoice or process your order.
The digital invoice will be sent by email to the address provided at the time of ordering.
3.1 PricesAll prices on the website are always quoted in euros and include VAT.
For businesses within the EU and non-EU entities, the price shown is to be considered net.
The prices of the items do not include either delivery charges or any additional costs for packaging or bank charges. Exceptions to this are the prices of ovens and dough mixers, for which delivery costs are included if payment is made by bank or postal transfer. Other payment methods may incur additional costs or commission charges (such as cash on delivery), which will appear under the ‘Shipping Costs’ heading.
The total cost of delivery will be disclosed to the customer before the purchase is confirmed.
The purchase contract is concluded upon the accurate completion of the order form and the customer’s consent to the purchase, expressed by accepting the terms ‘online’.
The customer may pay for the goods ordered using the payment methods indicated ‘online’ at the time of purchase.
4. Conclusion of the contract
The offers on the website www.alfonsoforni.com are not binding on the Seller and do not constitute an offer to the public, but merely an “invitation to treat”. The Buyer’s purchase order constitutes a binding contractual proposal. The purchase order is accepted by the Seller by means of an order confirmation sent by email, which includes a summary of the terms and conditions of sale (product description, price, payment methods). The contract is concluded and comes into effect when the Buyer receives the order confirmation. The order and the order confirmation are deemed to have been received when the parties to whom they are addressed are able to access the electronic messages.
Should the Buyer not receive the Order Confirmation from the Seller or any other communication from the Seller within 48 hours of placing the order, the Buyer must contact the Seller without delay at the following address: www.alfonsoforni.com
5. Warranty
5.1 The Seller’s Statutory Warranty
The Seller provides, in accordance with and for the purposes of Directive 44/99/EC, a statutory guarantee covering the product in the event of non-conformity with the qualities specified in the sales contract, in compliance with applicable legislation.
The guarantee entitles the Buyer, in the event of obvious defects or failure to manufacture the item in accordance with the product specifications, to obtain a replacement, bearing in mind that the items are handcrafted and therefore not mass-produced, which makes them unique.
In any event, the warranty does not cover the use of the goods in a manner not in accordance with that specified by the Seller/Manufacturer (instructions for use indicated on the product itself).
Any complaint must be submitted together with proof of purchase (tax document issued by the seller/proof of payment).
5.2 Where to submit complaints
The complaint must be submitted by the Purchaser promptly and no later than 10 days from the date on which they discovered the lack of conformity.
During this period, the product must not be used.
The complaint must be submitted electronically to the Seller, who will immediately inform the Buyer of the procedure for returning the product.
6. Products
6.1 Available products and purchase restrictions
NUNZIO ALFONSO S.R.L. shall not be liable in any way for the temporary or permanent unavailability of one or more products. In the event of the unavailability – even temporary – of the requested products, NUNZIO ALFONSO S.R.L. undertakes not to charge the Customer the corresponding price. The website highlights the cases in which restrictions apply to the purchase of individual products.
6.2 Product Images
The appearance of the products delivered may differ from that shown on the Website in the event of technical developments to the products themselves.
NUNZIO ALFONSO S.R.L. reserves the right, as part of the ongoing process of improving its handcrafted products, to make any technical, dimensional or aesthetic changes it deems necessary. Consequently, this does not entitle customers to request modified products or to cancel orders that have already been placed.
6.3 Product Representation and Use of Artificial Intelligence (AI)
The product images and promotional videos featured on this website are optimised for illustrative and marketing purposes through the use of artificial intelligence (AI) tools to create backgrounds and models. These technologies affect only the surrounding setting, leaving the actual characteristics, dimensions and technical specifications of the ovens for sale unchanged; these correspond exactly to the actual product dispatched to the customer.
6.4 Statutory Warranty and Product Liability
With regard to liability for damage caused by defective products and statutory guarantees of conformity for consumers, the current provisions of the Italian Consumer Code (Legislative Decree 206/2005 and subsequent amendments) apply, as well as the provisions of the Civil Code for professional purchasers (VAT-registered businesses).
7. Right of Withdrawal
Pursuant to and for the purposes of Articles 50 et seq. of Legislative Decree No. 206 of 6 September 2005 (Consumer Code) concerning distance contracts, the Purchaser is entitled to withdraw from this contract, without being required to state reasons or pay any penalty, within 14 working days from the date of receipt of the goods covered by the contract.
The right of withdrawal is deemed to have been exercised by sending, within the specified period of 14 days from receipt of the goods, a written notice by registered letter with acknowledgement of receipt to:
NUNZIO ALFONSO S.R.L.
Zona Industriale Giammoro
98042 - Pace del Mela (ME)
Should the Customer wish to exercise the right of withdrawal, they must, at their own expense, return the goods covered by the contract within 14 working days of the date of receipt of the goods, ensuring they are delivered to the address indicated above. The returned product must be in good condition and complete with all accessories, the original packaging and accompanying documents (invoice).
It is understood that the risks associated with the return shipment of the products shall be borne entirely by the Buyer.
Do not send the return cash on delivery, as it will be automatically rejected.
The Seller reserves the right to take up to 14 days to carry out checks on the condition of the returned product and to process any refund.
The refund will cover the full amount paid for the items purchased, excluding delivery costs.
8.1 Jurisdiction and applicable law
Any dispute relating to the application, performance, interpretation or breach of the sales agreements concluded via the website www.alfonsoforni.com is subject to Italian jurisdiction.
These General Terms and Conditions of Sale are governed by current Italian legislation and, in matters not expressly provided for herein, the provisions of Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 70/2003 on electronic commerce shall apply.
For any dispute relating to dealings with Customers acting in the course of business, commercial, craft or professional activities, the court of exclusive jurisdiction shall be that of Barcellona Pozzo di Gotto (ME).
In the case of a Customer classified as a consumer, territorial jurisdiction shall be determined in accordance with the mandatory provisions laid down by the applicable consumer protection legislation.
8.2 Alternative Dispute Resolution – (ODR)
On 15 February 2016, a European platform for the online resolution of consumer disputes (the so-called ODR platform) was established.
The ODR platform can be accessed at ec.europa.eu/consumers/odr; via this platform, you can consult the list of ADR bodies, find links to each of their websites and initiate an online dispute resolution procedure for the dispute in which you are involved.
Furthermore, please note that if you are a consumer and have submitted a complaint regarding a contract concluded via this website, but it has not been possible to resolve the dispute that is the subject of the complaint, NUNZIO ALFONSO S.R.L. - will provide you with information regarding the Alternative Dispute Resolution (ADR) body or bodies for the out-of-court resolution of disputes (as referred to in Articles 141-bis et seq. of the Consumer Code), specifying whether or not it makes use of such bodies to resolve the dispute in question.
In any event, whatever the outcome of the out-of-court dispute resolution procedure, your rights to bring the matter before the ordinary courts remain unaffected, and, where the conditions are met, to seek out-of-court resolution of consumer disputes through the procedures set out in Part V, Title II-bis of the Consumer Code.
9. Payment Methods
There are four main payment methods available:
1. ADVANCE BANK TRANSFER
You may make a bank transfer for the total amount of the order (goods + delivery charges) to NUNZIO ALFONSO S.R.L. via your bank or another current account, or pay in cash at any bank or branch.
The reference to be included on the transfer form must state the order number and the name of the person who placed the order online.
As bank transfers are not processed immediately, you must notify us in advance by sending an email with a copy of the completed transfer, clearly showing all payment details, in particular the C.R.O. (Transaction Authorisation Code), the ABI and CAB codes of the sending bank, to the following email address: info@nunzioalfonso.it.
Details to which the bank transfer should be made out:
NUNZIO ALFONSO S.R.L.
IBAN: IT48R0326822300052319365690
BIC SWIFT: SELBIT2BXXX
BANCA SELLA VIA ITALIA, 2 - 13900 - BIELLA
The order will be accepted and processed once the receiving bank has confirmed receipt of the payment.
The two working days required for dispatch will be counted from this point.
An order paid by bank transfer will be automatically cancelled if payment has not been received within 10 days of the order being placed.
Customers wishing to pay for an order from abroad must note the BIC/SWIFT code. Banca Sella’s BIC/SWIFT code is: SELBIT2BXXX
For purchases paid for by bank transfer, delivery is included in the price; for purchases paid for via PayPal or credit cards through the Stripe payment gateway, a delivery charge will be added to the total.
2. ONLINE PAYMENT VIA PAYPAL®
Payment is made via PayPal®, directly from the Buyer’s PayPal® account or using all types of credit cards and prepaid cards (such as Postepay). In the case of payment by credit card, the credit card details are sent to PayPal® or Banca Sella, which processes payments on behalf of the Seller.
Credit card details submitted when placing an order are protected against unauthorised access through encrypted data transfer.
During the online payment verification process, you will be redirected from our website www.alfonsoforni.com to the secure PayPal® website, whether you choose to pay via your PayPal® account or using any other card.
Please wait patiently for the PayPal® page to load (especially if you are using an iPad) and then enter your payment details.
At that point, you will receive an email from us thanking you for your order; however, if for any reason the payment via PayPal® is not successful, you will not receive an email from them confirming that the payment has been made.
Therefore, to be sure that your order has gone through successfully and that payment has been made, you must receive both an email from us and a confirmation email from PayPal®. If either of these emails does not arrive, please be aware that something has gone wrong. An order paid for online that remains pending is automatically cancelled after a couple of hours.
Once an order is sent to PayPal® for payment, it automatically disappears from our e-commerce site; therefore, if it remains pending, it is no longer possible to resume and complete it – you will need to place a new order.
3. CASH ON DELIVERY
Cash on delivery is a convenient and easy payment method; you can select this option when placing your order by clicking on ‘Cash on Delivery’.
This payment method incurs an additional charge of 20 euros for cash-on-delivery payments NOT EXCEEDING 1,000 euros in cash, and 40 euros for cash-on-delivery payments exceeding 1,000 euros in cash. If you choose this option, you will first need to pay a deposit and can then pay the remaining amount to the courier on delivery, but ONLY IN CASH.
- Upon delivery of the wood-fired oven, the courier will accept ONLY cash; NO cheques of any kind.
- The wood-fired oven will be unloaded at the kerbside; we do not provide a porter service, nor do we deliver to a specific floor or terrace (any such service is at the customer’s expense);
- Deliveries are made by lorry, therefore, if unloading is to take place in narrow streets, alleys, through gates or in confined spaces, we advise you to contact the relevant courier branch to agree on the most suitable vehicle for unloading the wood-fired oven and, above all, to accept the parcel ‘subject to reservation’.
4. INSTALMENT PAYMENTS, DEFERRED PAYMENTS AND ONLINE FINANCING (PayPal 3 Instalments, HeyLight, Klarna, seQura)
NUNZIO ALFONSO S.R.L., as a supplier of goods and services, offers its customers the option of instalment payments, deferred payments or online finance through its partners PayPal, HeyLight, Klarna and seQura, without having an exclusive agreement with any of them.
- Optimising the process: If you choose an instalment or finance payment option, we strongly recommend placing your order from a PC (desktop or laptop). When using a smartphone, tablet or other mobile device, the authentication and biometric verification procedures required by the respective providers may, in rare cases, not function correctly or may not be optimised.
- Contractual and financial terms: For all specific contractual and financial terms relating to instalment payment or consumer credit services, please refer exclusively to the information and contractual documentation made available by the individual providers on their respective official channels (paypal.com, heylight.com, klarna.com, sequra.com). The instalment or credit agreement is deemed to be concluded directly and exclusively between the Customer and the selected lender.
- Costs and administration fees: The Customer acknowledges and accepts that the use of certain instalment or deferred payment schemes entails the application of a fixed fee to cover the technical and collection costs of the financial service. These fees (amounting to €14.92 for the Klarna scheme, €10.47 for the seQura scheme and €7.53 for the PayPal/Credit Card scheme) are calculated with full transparency and added to the total order amount before final confirmation at checkout. For the HeyLight service, the rates and terms are calculated in real time by the partner based on the plan duration chosen by the customer.
- Assessment and approval of the application: Acceptance of the application for payment by instalments, deferred payment and/or financing is at the sole and exclusive discretion of the selected financial institution or fintech platform (PayPal, HeyLight, Klarna, seQura), in accordance with their automated procedures and internal risk assessment criteria.
- Privacy protection and rejection: No sensitive data, identity documents or financial information relating to the instalment payment request will be provided to NUNZIO ALFONSO S.R.L., with the exception of the outcome of the transaction (Approved/Rejected). In the event of a negative outcome or rejection of the application by the chosen payment provider, NUNZIO ALFONSO S.R.L. will not be informed of the reasons and cannot be held responsible for the purchase not being completed.
10. Liability
NUNZIO ALFONSO S.R.L. accepts no liability for disruptions attributable to force majeure, such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevent, in whole or in part, the performance of the contract within the agreed timeframe.
NUNZIO ALFONSO S.R.L. is not liable for any fraudulent or unlawful use that may be made by third parties of credit cards or other means of payment when paying for the purchased products. Indeed, at no stage during the purchase process is NUNZIO ALFONSO S.R.L. able to access the purchaser’s credit card number, which is transmitted directly to the payment service provider (PayPal) via a secure connection.
11. Obligations of the purchaser
The purchaser is strictly prohibited from entering false, and/or fabricated, and/or fictitious data during the registration process required to initiate the procedure for the performance of this contract and any related further communications.
The Customer indemnifies NUNZIO ALFONSO S.R.L. against any liability arising from the issue of incorrect tax documents due to errors relating to the data provided by the Customer, the Customer being solely responsible for ensuring the correct entry of such data.
12. Delivery
-
Order preparation
Please note that upon receipt of the order, the goods must be collected from the warehouse, which is responsible for preparing the order. Generally, the order is prepared within 1 or, at most, 2 working days; if the oven is not in stock, you will need to allow for production lead times.
-
Delivery times
The courier will take between 3 and 10 working days for standard delivery under normal circumstances, and 48–72 hours if express delivery is selected.
If the goods ordered need to be delivered urgently, please specify this in your order.
