Terms and Conditions of Sale

In the case of a Customer who qualifies as a consumer, the competent court shall be that of the place of residence or domicile of the consumer, in accordance with the provisions of the applicable consumer protection legislation.

These terms and conditions govern the contract of sale between the purchaser (hereinafter referred to as the “Purchaser”) and NUNZIO ALFONSO S.R.L., with its registered office at Zona Industriale Giammoro - 98042 Pace del Mela (ME), registered in the Messina Companies Register under number ME-252028, VAT No. IT03655770836, certified email address: nunzioalfonsosrl@pec.it (hereinafter referred to as the “Seller”).

1. Content of the general terms and conditions of sale

The following general terms and conditions of sale govern all sales contracts concluded between the Buyer and the Seller via the website www.alfonsoforni.com. Each contract is subject to the general terms and conditions of sale published on the website at the time the contract is concluded.

Any amendment proposed by the Buyer shall not be deemed to alter the general terms and conditions of sale unless expressly accepted in writing by the Seller.

2. Parties to the contract and geographical area

The online shop at www.alfonsoforni.com is intended for the exclusive use of consumers; that is, it is reserved for retail sales.

3. Invoices

If you require an invoice to be issued to a private individual or a VAT-registered business, you must provide your tax code, VAT number and certified email address (PEC). Without these details, we will be unable to issue an invoice or process your order.

The digital invoice will be sent by email to the address provided at the time of ordering.

3.1 Prices

All prices on the website are always quoted in euros and include VAT.
For EU businesses and non-EU entities, the price shown is to be considered net.
Item prices do not include shipping costs or any additional costs for packaging or bank charges. Exceptions to this are the prices of ovens and dough mixers, which include shipping costs if payment is made by bank or postal transfer. Other payment methods may incur additional costs or commission fees (such as cash on delivery), which will appear under the heading ‘Shipping Costs’.
The total shipping cost will be disclosed to the customer prior to purchase confirmation.
The purchase contract is concluded upon the accurate completion of the order form and the customer’s consent to the purchase, expressed by accepting the terms “online”.
The customer may pay for the goods ordered using the payment methods indicated “online” at the time of purchase.

4. Conclusion of the contract

The offers on the website www.alfonsoforni.com are not binding on the Seller and do not constitute an offer to the public, but merely an “invitation to treat”. The Buyer’s purchase order constitutes a binding contractual proposal. The purchase order is accepted by the Seller via an order confirmation sent by email, which includes a summary of the terms and conditions of sale (product description, price, payment methods). The contract is concluded and comes into effect when the Buyer receives the order confirmation. The order and the order confirmation are deemed to have been received when the parties to whom they are addressed have access to electronic messages.

Should the Buyer not receive the Order Confirmation from the Seller or any other communication from the Seller within 48 hours of placing the order, the Buyer is required to contact the Seller promptly at: www.alfonsoforni.com

5. Warranty

5.1 The Seller’s Statutory Warranty

The Seller provides, pursuant to and for the purposes of Directive 44/99/EC, a statutory warranty on the product for non-conformity with the qualities specified in the sales contract, in accordance with applicable legislation.

The warranty entitles the Buyer, in the event of obvious defects or failure to manufacture the item in accordance with the product specifications, to obtain a replacement, bearing in mind that the items are handcrafted and therefore not mass-produced, which distinguishes them as unique.

In any case, the warranty does not cover the use of the goods in a manner not in accordance with that specified by the Seller/Manufacturer (instructions for use indicated on the product itself).

Any complaint must be submitted with proof of purchase (tax document issued by the seller/payment receipt).

5.2 Where to submit complaints

The complaint must be submitted by the Buyer promptly and no later than 10 days from the date on which they discovered the lack of conformity.

During this period, the product must not be used.

The complaint is submitted electronically to the Seller, who will immediately inform the Buyer of the procedures for returning the product.

6. Products

6.1 Available products and purchase restrictions

NUNZIO ALFONSO S.R.L. shall in no way be liable for the temporary or permanent unavailability of one or more products. In the event of unavailability, even temporary, of the requested products, NUNZIO ALFONSO S.R.L. undertakes not to charge the Customer the corresponding price. The website highlights cases where purchase restrictions apply to individual products.

6.2 Product Images

The appearance of the products delivered may differ from that shown on the Website in the event of technical developments to the products themselves.

NUNZIO ALFONSO S.R.L. reserves the right to make any technical, dimensional or aesthetic changes it deems necessary as part of the ongoing process of improving its handcrafted products. Consequently, this does not entitle customers to request modified products or the cancellation of orders already placed.

6.3 Product Liability

The provisions of Directive 85/374/EEC apply with regard to damage caused by the product.

7. Right of withdrawal

Pursuant to and for the purposes of Articles 50 et seq. of Legislative Decree No. 206 of 6 September 2005 (Consumer Code) concerning distance contracts, the Purchaser is entitled to withdraw from this contract, without being required to state reasons or pay any penalty, within 14 working days from the date of receipt of the goods covered by the contract.

The right of withdrawal is deemed to have been exercised by sending, within the specified period of 14 days from receipt of the goods, a written notice by registered letter with acknowledgement of receipt to:

NUNZIO ALFONSO S.R.L.
Zona Industriale Giammoro
98042 - Pace del Mela (ME)

Should the Customer wish to exercise the right of withdrawal, they must, at their own expense, return the goods covered by the contract within 14 working days of the date of receipt of the goods, ensuring they are delivered to the address indicated above. The returned product must be intact and complete with all accessories, original packaging and accompanying documents (invoice).

It is understood that the risks associated with the return shipment of the products shall be borne entirely by the Buyer.

Do not send the return cash on delivery as it will be automatically rejected.

The Seller reserves up to 14 days to carry out checks on the condition of the returned product and to process any refund.

The refund will cover the full amount paid for the items purchased, excluding shipping costs.

8.1 Jurisdiction and applicable law

Any dispute relating to the application, performance, interpretation and breach of the sales agreements concluded via the website www.alfonsoforni.com is subject to Italian jurisdiction.

These General Terms and Conditions of Sale are governed by current Italian legislation and, insofar as not expressly provided for herein, the provisions of Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 70/2003 on electronic commerce shall apply.

For any dispute relating to dealings with Customers acting in the course of business, commercial, craft or professional activities, the exclusive place of jurisdiction shall be Barcellona Pozzo di Gotto (ME).

In the case of a Customer classified as a consumer, territorial jurisdiction shall be determined in accordance with the mandatory provisions laid down by the applicable consumer protection legislation.

8.2 Alternative Dispute Resolution (ODR)

Since 15 February 2016, a European platform for the online resolution of consumer disputes (the so-called ODR platform) has been established.

The ODR platform is accessible at ec.europa.eu/consumers/odr; through it, you can consult the list of ADR bodies, find the link to each of their websites and initiate an online dispute resolution procedure for the dispute in which you are involved.

Furthermore, we would like to remind you that, if you are a consumer and have submitted a complaint regarding a contract concluded via this website, but it has not been possible to resolve the dispute that is the subject of the complaint, NUNZIO ALFONSO S.R.L. - will provide you with information regarding the Alternative Dispute Resolution body or bodies for the out-of-court resolution of disputes (so-called ADR bodies, as indicated in Articles 141-bis et seq. of the Consumer Code), specifying whether or not it makes use of such bodies to resolve the dispute in question.

In any event, whatever the outcome of the out-of-court dispute resolution procedure, your rights to bring the matter before the ordinary courts remain unaffected, and, where the conditions are met, to seek out-of-court resolution of consumer disputes through the procedures set out in Part V, Title II-bis of the Consumer Code.

9. Payment Methods

There are 4 main payment methods available:

1. ADVANCE BANK TRANSFER

You may make a bank transfer for the total amount of the order (goods + delivery charges) to NUNZIO ALFONSO S.R.L. via your bank or another current account, or pay in cash at any bank or branch.

The reference to be indicated on the transfer form must include the order number and the name of the person who placed the order online.

As bank transfers are not processed immediately, you must notify us in advance by sending an email with a copy of the completed transfer, clearly showing all payment details and in particular the Transaction Authorisation Code (TAC), ABI and CAB of the sending bank, to the following email address: info@nunzioalfonso.it.

Details for the bank transfer:

NUNZIO ALFONSO S.R.L.
IBAN: IT48R0326822300052319365690
BIC SWIFT: SELBIT2BXXX
BANCA SELLA VIA ITALIA, 2 - 13900 - BIELLA

The order will be accepted and processed upon confirmation of the payment by the receiving bank.

The two working days required for dispatch will be counted from this point.

An order paid for by bank transfer will be automatically cancelled if payment has not been received within 10 days of the order being placed.

Customers wishing to pay for an order from abroad must note the BIC SWIFT code. Banca Sella’s BIC SWIFT code is: SELBIT2BXXX

For purchases paid for by bank transfer, delivery is included in the price, whilst for purchases made via PayPal and credit cards through the Stripe payment gateway, a delivery charge will be added to the total.

2. ONLINE PAYMENT VIA PAYPAL®

Payment is made via PayPal®, directly from the Buyer’s PayPal® account or using all types of credit cards and prepaid cards (such as Postepay). In the case of payment by credit card, the credit card details are sent to PayPal® or to Banca Sella, which handles payments on behalf of the Seller.

Credit card details submitted during the ordering process are protected against unauthorised access through encrypted data transfer.

During online payment validation, you will be redirected from our website www.alfonsoforni.com to the secure PayPal® site, whether you choose to pay via your PayPal account or with any other card.

Please wait patiently for the PayPal® page to load (especially if you are using an iPad) and then enter your payment details.

At that point, you will receive an email from us thanking you for your order; however, if for any reason the payment via PayPal® is not successful, you will not receive an email from them confirming that you have made the payment.

Therefore, to be sure that the order has been successfully processed and that payment has been made, you must receive both an email from us and a confirmation email from PayPal®. If either of these emails does not arrive, please be aware that something has gone wrong. An online payment order that remains pending is automatically cancelled after a couple of hours.

Once the order is sent to PayPal® for payment, it automatically disappears from our e-commerce site; therefore, if it remains pending, it is no longer possible to resume and complete it – it must be placed again.
